Article 1 - Subject matter
1. These general terms of use represent access to and use of the website of GMReals Group s.r.o. (hereinafter referred to as the “Owner”), which is accessible at the URL: https://www.gmrealsgroup.com/ and whose activities are governed by these general terms of use.

Article 2 - Changes to the terms of use
1. The Owner may amend or update these general terms of use in whole or in part. Changes and updates to the General Terms of Use will be notified to users on the home page as soon as they are adopted and become binding as soon as they are published on the Website in this section. Access to and use of this site assumes that the user accepts these terms of use.
Article 3 - Intellectual property
1. All website content, such as works, images, photographs, text, music, audio and video, documents, drawings, logos and any other material published in any format on the Website itself, including menus, websites, graphics, colors, diagrams, tools, fonts and site design, diagrams, layouts, methods, processes, functions and software that is part of the site are protected by copyright and other intellectual property rights of the Owner or any third party with whom the contract is concluded. Copying of all or part of the site in any form without the express written consent of the Owner is prohibited.

Article 4 - Use of the Website and user responsibility
1. Access to and use and display of the Website, including communication with the Owner, constitute activities which the user carries out exclusively for personal use and which are not related to any business, entrepreneurial or professional activity.
2. The user is personally responsible for the use of the Website and its content. Therefore, the Owner cannot be held liable for the use of the Website and its content on behalf of any user of the Website that does not comply with the law, without prejudice to liability for willful misconduct and gross negligence. The user will thus be the only person responsible for communicating incorrect, false or related information and data to third parties without the user’s consent, as well as for the incorrect use of the Website, which may occur as a result of these facts.
3. Any material downloaded or otherwise obtained through the software service is at the user's own risk and expense, and therefore any responsibility for any damage to computer systems or loss of data resulting from downloaded operations falls on the user and cannot be attributed to the Owner.
4. The Owner disclaims any liability for damages caused by unavailability of services on the Website or for damages caused by viruses, damaged files, errors, omissions, interruptions of service, deletion of content, problems with network, provider or telephone or telematics connection, unauthorized access, data changes and failure and / or malfunction of the user's electronic device.
5. Users are responsible for the safe and correct use of their personal data, including credentials that allow access to the reserved services, as well as for any harmful consequences or prejudices that may arise to GMReals Group s.r.o. or third parties as a result of improper use, loss or theft of this information.

The Owner has taken all reasonable steps to prevent the publication of content and images on the site that could be considered detrimental to good morals, human rights and human dignity in all possible forms and expressions. In any case, if the above content is considered harmful to religious or ethical feelings or violates good morals, the user is asked to notify the Owner, who warns that any access to the content considered harmful or offensive is at the expense of the user, at the user’s own undisputed judgment and the user’s sole personal responsibility.

The Owner has also taken all useful measures to ensure that all information on the Website is correct, complete and up-to-date, but bears no responsibility to users for the accuracy and completeness of the content published on the Website, unless otherwise provided by law. Article 5 - Exclusion of liability
1. As stated above, the Owner carries out the utmost care and maintenance of the Website and its content, but does not assume any responsibility for the accuracy, completeness and timeliness of the data and information available on the Website or related sites. Therefore, any liability for errors or omissions arising from the use of data and information on the Website must be excluded.
2. The Owner disclaims all liability, including possible errors, bug fixes, as well as liability for the server hosting the site; nor is it responsible for the use of the information contained or for its accuracy and reliability. In no event, even in the event of negligence, shall the Owner be liable for any direct or indirect damages that may result from the use or inability to use the materials on the site.
Article 6 - Restrictions on the provision of services
1. The Owner cannot be held liable for damages resulting from non-provision of the service due to incorrect or non-functional electronic means of communication for reasons beyond the Owner’s control. These may include server and other electronic device failures, even if they are not an integral part of the Internet, installed software failures, the possible presence of computer viruses and other malicious computer components, as well as attacks by hackers or other network access users. The user therefore undertakes not to cause damage and to save the Owner any liability and / or claims in this regard.
Article 7 - Links to other websites
1. The Website may contain hyperlinks to other websites that are not affiliated with it. The Owner does not control or monitor these websites and is therefore in no way responsible for the management of their content or data. Therefore, the user must carefully read the terms of use of the third-party websites visited and the related privacy policy, as these terms of use and privacy policy only apply to these sites.
Article 8 - Links from other websites
1. The Website may also be accessed from third party websites that contain a link or banner to access the Website.
2. The activation of such links to the Website from third party websites is always possible, provided that it does not in any way violate these general terms of use.
3. The activation of unauthorized links entitles the Owner to the immediate deactivation of such unauthorized links and also to report on use for commercial purposes or unfair commercial practices, or to the detriment of the good name and reputation of the Owner, the Owner’s services and companies of the same group. In any case, the activation of hyperlinks (frames or deep links) to the web or the unauthorized use of tags (labels) is prohibited.

Article 12 - Applicable law and jurisdiction
1. These General Terms and Conditions of Use shall be governed by and construed in accordance with Italian law, without prejudice to any other rules in force in the buyer's country of habitual residence. The interpretation, transposition and termination of the general conditions of use are therefore ultimately governed exclusively by Italian law.
2. All disputes relating to and / or arising from these conditions shall be settled exclusively by the Italian judicial authority. In particular, if the buyer has the status of a consumer, all disputes must be resolved by the court of the place of residence or domicile in accordance with the applicable law.
